New law allows ex-criminals to close records

A new Indiana law, which became effective on July 1, 2011, will allow ex-offenders to seal information about their convictions from the general public.  The convictions must not include sex crimes or violent crimes and the offender must have completed his or her sentence more than eight years ago to be eligible.  While the law may restrict access to the general public, law enforcement agencies may still view the “sealed” records in order to perform a criminal background check.

Hot Coffee

On Monday, June 27th at 9PM, Hot Coffee will premier on HBO.  The documentary examines the infamous case of the elderly woman who spilled coffee on herself, after purchasing the beverage from a McDonald’s drive-through.  The case is often cited as an example of everything wrong with our judicial system; however, “Coffee” will educate viewers as to what really happened to Stella Liebeck, and the efforts taken by various special interests groups to further their own goals in corroding peoples’ rights.

Indiana passes texting ban

Beginning July 1, 2011, Indiana drivers will be prohibited from typing or sending a text message or email while driving, regardless of age, unless he or she does so using hands free or voice operated technology.   A violation of this statue will result in a Class C infraction.  However, as many commentators have already noted, there appear to be huge flaws in the current bill (see Chirs Pearcy’s article in the Indiana Lawyer).   While it may be illegal to type or receive a text, even if you are caught doing so by a police officer, that officer may not confiscate your phone in order to determine if you have broken the law.  All the guilty party has to do is deny noncompliance with the law and there isn’t much the officer can do to prove otherwise.  While the new law may be difficult to enforce, it will hopefully make people more aware of the dangers associated with texting while driving.

Heiress leaves millions to man’s best friend

When Gail Posner, daughter of corporate takeover artist, Victor Posner, died this March, her will provided that her pet chihuahua, Conchita, had the right to live in her seven-bedroom, $8.3 million mansion.  To ensure her four-legged friend would live in comfort, a $3 million trust fund was established to provide for all of Conchita’s future, canine needs.  Meanwhile, Ms. Posner’s only living child was bequeathed a “paltry” $1 million.  The child subsequently filed a lawsuit contesting the validity of the will.
