An Australian court has recently allowed a lending company to serve documents via Facebook, a popular social networking Website. The court approved such “service” after numerous failed attempts to reach the defendants at their residence. Service by this means is not currently allowed in Indiana. Generally speaking, a defendant in this state may be served with a summons in one of three ways:
1) personally delivering the summons to the defendant or the defendant’s agent;
2) leaving a copy of the summons at the defendant’s dwelling; or

According to a recent article by the Louisville Courier-Journal, Indiana Senator, Travis Holdman, plans to introduce a bill next year that would prohibit minors from using cell-phones while driving. If the bill is passed, Indiana would join seventeen other states which have similar laws that restrict or completely ban the use of hand-held phones by young drivers.

A bill, which would have increased the minimum amount of liability car insurance a person must have for damages resulting in “bodily injury”, failed to pass both the House and Senate in last year’s Indiana General Assembly. Currently, a person is only required to have liability coverage of $25,000 per person and $50,000 per accident. The proposed bill would have increased those limits to $40,000 and $80,000, respectfully.

Once again, Montgomery, Elsner & Pardieck will be sponsoring and coaching a high school team in the state bar association mock trial competition. Teams are composed of 6 members, 3 who represent the plaintiff and 3 who represent the defense. All teams are given the same set of facts to try against other high school teams. Each round of competition is tried before a judge and scored by the judge and observing lawyers. Twice weekly practices start Sunday December 7.
